Renting a property in Dubai can be an exciting endeavour, offering a plethora of options in a vibrant city. However, navigating the paperwork and procedures can seem daunting at first. One of the essential aspects of renting a property in Dubai is ensuring that all the necessary documents are in order.
Let’s go through the documents required for renting a property in Dubai.
Documenting Your Tenancy Contract
The documents required to rent a property in Dubai include a tenancy contract, which is essential to formalise the agreement between the tenant and landlord. Here are the required documents for documenting your tenancy contract:
- Copies of Passport and Emirates ID (both landlord and tenant)
- Residence visa copy
- Proof of refundable security deposit payment (one month’s rent or 5% of the rent)
After documenting the tenancy contract, review it thoroughly and sign the agreement. Now, the next step is to get the tenancy contract registered with Ejari in Dubai.
Ejari Registration in Dubai
Ejari registration is a crucial step in renting a property in Dubai, ensuring that lease contracts are legally recognised by the Dubai Land Department (DLD). Both landlords and tenants share the responsibility for Ejari registration, with tenants often completing the process and covering associated fees. Here’s what you need to know about Ejari registration:
Tenancy Laws
The RERA tenancy laws in Dubai outline crucial terms and conditions for lease contracts. These include discussing the tenancy term until which the contract will remain valid.
Moreover, landlords can increase rent by up to 20% if it’s significantly below market value, approximately 40% less, with a 90-day notice period. RERA also outlines the rights and responsibilities of tenants in Dubai indicating that tenants have the right to early termination.
On the flip side, landlords can give tenancy eviction notices in Dubai for non-payment of rent or property damage with a 30-day notice period. Additionally, it is essential to include tenancy terms and an early exit clause in the lease agreement, before registering it with the Ejari.
Ejari Registration Methods
Ejari registration can be done through Real Estate Trustee Centres or Ejari-authorised typing centres. Nonetheless, the registration can also be done online via the DLD website or mobile applications such as Dubai REST (Android | iOS) or DubaiNow (Android | iOS).
Documents Required for Ejari Registration
Here are the documents required for a property lease in Dubai for Ejari registration:
Property Owners / Landlords
- Copy of Emirates ID and passport (for expat owners)
- Copy of property ownership documents
Company / Business
- Copy of trade licence
- Copy of property ownership documents
- Copy of Emirates ID and passport (for expat representatives)
- Authorisation letter from the company listing authorised employees for using the Ejari system
- Passport and Emirates ID copies of authorised employees
Agents Applying on Behalf of Landlords
- Copy of passport and Emirates ID
- Copy of agent’s passport and Emirates ID
- Copy of Power of Attorney or legal guardianship order
Tenants
- Original lease agreement
- Emirates ID copy
- Copy of Power of Attorney (in case of a representative applying for Ejari registration)
Renewal of Ejari
Once the previous tenant vacates the premises, the landlord must initiate the cancellation of the tenancy contract registration. Failure to cancel the previous registration can impede the registration process for the new tenant’s leasing agreement with Ejari.
To cancel Ejari registration, landlords can conveniently apply at the Ejari typing centres in Dubai. They need to provide a No Objection Certificate (NOC) or a cancellation letter along with a copy of the leasing agreement of the departing tenant. This process ensures a smooth transition between tenants and maintains compliance with regulatory requirements.
The documents needed for renewing Ejari in Dubai are the same as those required for the initial Ejari registration process. However, there are a few additional documents necessary for renewal, which are outlined below:
- Recent DEWA bill or letter with the metre number
- Undertaking form for renewal via Real Estate Services Trustee
- Tenant’s visa, Emirates ID and passport copies
- Title deed
- Copy of previous Ejari registration
DEWA Connection
After signing the tenancy contract, the next step is to arrange water and electricity connections through the Dubai Electricity and Water Authority (DEWA). To obtain DEWA services, follow these steps:
- Download DEWA’s app and enter Ejari’s contract number.
- Upload copies of Emirates ID and passport (of both landlord and tenant).
- Complete the DEWA form.
- Pay the security deposit and operation fees.
Once the deposit amount is paid, the service will be activated within 24 hours of the payment.
