All about Offer and Deposit Service by DLD
Dubai Land Department – DLD, oversees the property transaction and other related activities in Dubai. The department is responsible to enforce rules and regulations to protect the rights of parties involved in the real estate industry. Thanks to the strict laws and services offered by DLD, it is convenient to buy, sell or rent property in the busy metropolis. Similarly, the Offer and Deposit service by DLD is one of its user-friendly e-services. The service allows tenants to deposit the rent directly to the DLD if the landlord refuses to accept it. Let’s learn more about this service in detail.
What is Offer and Deposit Service by DLD?
As per the tenancy laws in Dubai, a landlord can increase the rent according to the RERA rent calculator. If the rental value is 40% below the market value, landlords can raise the rent by a maximum of 20%. Despite this, the landlord must give 90 days’ notice before raising the rent.
However, if the increased rent is beyond the rental index, a tenant can file the Offer and Deposit motion with DLD. The Offer and Deposit service allows tenants to file a motion asking the Provisional and Summary Actions Court to issue an order without impairing their rights. A judge at the Rental Dispute Settlement Centre reviews the case and if the decision is in the tenant’s favour, they can submit the rent to the landlord via DLD.
Here are the details of the documents required, service procedure and fees for availing the Offer and Deposit service by DLD.
Documents Required
Submit the following documents to avail the Offer and Deposit by DLD.
- Offer and Deposit motion
- Notification form and document portfolio
- Copy of new lease with same terms and conditions
- Copy of correspondence between parties (if any)
- A copy of Emirates ID (if the litigant is a regular person), or a copy of the manager’s Emirates ID and commercial licence (if the litigant is a legal person or a corporate company or establishment)
- Copy of last signed lease
Service Terms and Conditions
- Deposit notice from the lessee to the lessor.
- Any documented proof of the lessor not accepting the rent. This may include a tenancy eviction notice to the lessee, proof of an ongoing legal dispute, correspondence stating that the lessor declined the rent or the lessee’s notice to the lessor of rent offer for the expired period with the lessor’s notice of acknowledgement.
- After serving notice to the lessor, the lessee must deposit their original cheques with RDC.
- The motion shall be filed but closed if the depositor fails to provide proof of the lessor receiving the notice within ten business days.
- The premises keys will be deposited upon expiry of the tenancy period along with utility bills and rent clearance, provided that the contract specifies a termination condition, the lessor consents or the lessee submits an eviction judgement issued by the RDC.
- The rent deposited will be accepted by the lessee, their attorney or a member of the lessee’s family.
Note: No hard copies will be accepted; all documents must be submitted online via the RDC website following the system’s regulations. The documents must be in Arabic or translated legally into Arabic.
Procedure
There are two Offer and Deposit DLD service procedures to file a motion. The service time is usually one business day.
Through Real Estate Trustees’ Centre
- Submit the required documents to any of the Real Estate Trustees’ Centres.
- The employee enters the transaction data into the system for further verification and approval.
- Receive the receipt of payment after paying the service fees.
- Based on the decision, deposit the cheque or keys.
Through DLD website
- Sign up in the RDC system (if not registered before) and choose the Offer and Deposit service. Or, login to the DLD’s website using Emirates ID or simply sign up with the UAE Pass.
- Upload the required documents.
- Electronically pay the fees.
- Receive the Judge’s decision through the webpage.
Service Fees
The Offer and Deposit service by DLD requires the submission of the following fees:
- Offer and Deposit service fee: AED 50
- Fast Track Notification fee: AED 52.5
- Knowledge fee: AED 10
- Innovation fee: AED 10
A service partner fee of AED 130 + VAT is applicable in case the customer applies for the service through one of the Real Estate Trustees’ Centres.
Note that the cheque or cash rent deposit shall be either submitted to the landlord upon signing of a new contract or refunded to the tenant if the application is cancelled.
