A tenancy contract in Abu Dhabi legally binds landlords and tenants for a certain period. During this period, both parties are obligated to fulfil their responsibilities as per the law. However, in case of any uncertainty, the tenancy contract can be ended earlier than the decided date. That said, legal compliance is necessary for early termination of a tenancy contract.
Let’s take a closer look at the early termination of the tenancy contract in Abu Dhabi and the steps required to do so.
Cancel a Lease Contract in Abu Dhabi
Similar to registering a tenancy contract in Abu Dhabi, termination also required tenants and landlords to follow certain legal guidelines. However, prior to moving towards the steps to terminate the contract, here are a few things to consider.
Understand Legal Framework
Prior to initiating the lease contract cancellation in Abu Dhabi, it is suggested to know the laws that govern termination. The Law No. 4 of 2010 governs the tenant-landlord relationship. As per the law, the tenants have the right to the early termination of the contract with a 60-day prior notice to the landlord.
Tenants will have to pay a penalty to the landlord, usually, the penalty is equal to the rent of 1 month. The amount of the early termination penalty is pre-discussed and mentioned in the rental agreement. Besides, here are some other rights of tenants in Abu Dhabi that you must be aware of.
Read Contract Clauses
Rental contracts usually have an exit clause which elaborates on all the conditions regarding early termination. Read the clause properly and cater to the conditions it mentions. Please remember that these conditions are aside from the penalty. That said, to avoid this hassle next time, create a tenancy contract checklist and discuss every clause before signing the contract.
Discuss with Landlord
It is advised to discuss and negotiate issues with the landlord. Elaborate on the reason for exiting early and negotiate the exit deal. This will not only help in building a healthy tenant-landlord relationship but can also save you from paying a penalty.
Search for Other Options
Searching for a substitute tenant might save you from paying penalties. Discuss it with the landlord and convince them to null and void the exit clause in exchange for a new tenant.
Seek Legal Assistance
In case of complexities, while discussing issues with the landlord, it is recommended to seek legal assistance.
